Today, in a status conference with Lambda Legal in federal court in Chicago, the Department of Justice announced that the Social Security Administration ( SSA ) will apply the U.S. Supreme Court’s recent landmark marriage ruling retroactively and process pending spousal benefits claims for same-sex couples who lived in states that did not previously recognize their marriages.

Less than three months after the Supreme Court ruling that legalized same-sex marriage in all 50 states, the National Committee to Preserve Social Security & Medicare Foundation (NCF) in partnership with the LGBT Center of Orange County announces an important Town Hall Meeting at the Delhi Center in Santa Ana, CA, September 28th, 2015 to discuss Social Security benefits available to LGBT seniors. Know Your Rights Initiative/California encourages people ages 55 years and older, particularly those who are in same-sex marriages or contemplating a same-sex marriage to attend but all are welcome.

Congress Member Mike Honda opened the LGBT Town Hall in San Jose with a thanks to the LGBT community for its grassroots work over the years that created a better world in which his Trans granddaughter will grow up. He pledged to continue his work in Congress to make sure all same-sex couples have access to Social Security as we do in California.

Asked Monday if the Trump administration would address “entitlement reform,” White House chief economic advisor Larry Kudlow said it will “probably” look at “larger entitlements” next year. Entitlement reform generally refers to changes or cuts to large government social programs such as Social Security, Medicare, Medicaid or food stamps.

“The Social Security Administration has finally adjusted Kathy’s monthly SSA benefit to recognize the reality that she was married to her wife Sara and is a widow entitled to the same treatment as other survivors. We are also pleased to announce that the SSA has finally updated its instructions to its staff in accordance with the historic Obergefell v. Hodges ruling last June,” said Susan Sommer, National Director of Constitutional Litigation at Lambda Legal.
